Will I Get Alimony in my Divorce?
You may be entitled to alimony. There are different types of alimony that you may be entitled to: temporary alimony, bridge-the-gap alimony, rehabilitative alimony, durational alimony, and permanent alimony.
The type of alimony that you may be entitled to depends on the length of your marriage. Typically, the longer the duration of the marriage, the more time in which you may anticipate receiving alimony.
Once there has been a finding of entitlement (a need for alimony), the amount of alimony will depend on the payor’s ability to pay and payee’s need for that support.
There are no guidelines as to amount of alimony that will be paid. It is determined on a case-by-case basis based on the court’s determination of how much one needs and another is able to provide.
Alimony may be modifiable, depending on the type of alimony and the agreement or order that established the alimony. If it is modifiable, it may be modifiable as to the amount, the duration, or the amount and duration combined. Typically, as with any changes that are requested of an existing court order, you will need to establish a substantial change of circumstances in order to modify your alimony.
