Advanced Procedural Counsel: Appellate Law and Foreign Judgment Enforcement
Finality in family law is often complex. At the law office of Mary Zogg., we provide counsel for specialized procedural matters that occur either after a final judgment is entered (Appeals) or when a judgment originated outside of Florida (Domestication of Foreign Judgments). These high-level procedural services require meticulous attention to detail and rigorous adherence to specific rules of court.
Appeals: Challenging or Defending Final Judgments
An appeal is the process of asking a higher court (the appellate court) to review a decision made by a lower court (the trial court). An appeal is not a retrial of the facts; it is an argument that the trial judge made a mistake of law or procedure that resulted in an incorrect or unjust ruling.
Our Appellate Services
- Challenging Rulings: We represent clients who seek to appeal a final judgment on matters such as the calculation of alimony, equitable distribution, or the interpretation of a parenting plan. This involves identifying specific legal errors, meticulously preparing the appellate record, and submitting detailed written briefs and oral arguments to the appellate court.
- Defending Rulings: We also represent clients whose favorable trial court judgment has been challenged by the opposing party. Our role is to strategically defend the integrity of the trial court’s order and process.
- Focus on Legal Error: Appeals must be based on an argument that the trial court abused its discretion or misapplied the law. They are not intended to re-argue facts or change a judge’s subjective view of the evidence.
Appellate law is a highly specialized field, requiring unique legal writing and procedural skills that differ significantly from trial work.

Domestication of Foreign Judgments
In a highly mobile state like Florida, it is common for clients to arrive with divorce decrees, support orders, or parenting plans issued by courts outside of Florida, often referred to as “foreign judgments.” These judgments are not automatically enforceable in Florida until they are formally recognized.
Ensuring Enforceability in Florida
- Domestication of Judgments: This is the legal process of formally registering a judgment (decree or order) from another state or country with the appropriate Florida circuit court. Once domesticated, the judgment has the same legal force and effect as if it were initially rendered by a Florida court.
- Enforcement: Domestication is the essential first step to pursuing Enforcement actions in Florida, such as wage garnishment for unpaid child support or a contempt action for failure to comply with a time-sharing order, based on the original judgment.
- Interstate Support: We assist clients in navigating the Uniform Interstate Family Support Act (UIFSA) and other procedural rules necessary to establish, enforce, or modify support orders across state lines.
