Every couple that is thinking of getting married should have the “prenup talk.” A prenup (prenuptial agreement) is a contract that is written and signed before a couple is married, which lists each party’s individual property and financial rights before the marriage and in the event that they get divorced. You don’t have to be a celebrity or a millionaire to benefit from signing a prenup agreement. If you are honest about why you want one and give a full disclosure of your assets to each other, it should not be a deal breaker. If signing a prenup turns out to be a deal breaker for your future spouse, then perhaps they are not the right person for you.

There are many reason why you may want to consider a prenup before marriage. Do you own stock, have a retirement fund, or own property or a business? You may want to have in writing how you want those assets allocated in case of a divorce. If you have children from a previous marriage, you may want yours assets to be divided among your children and spouse at a certain percentage. Also those same children may still have to go to college and those funds can be discussed in a prenup. Another consideration for a prenup is having elderly parents to care for or maybe receiving an inheritance that you want specifically allocated. One partner may be wealthier than the other. Protecting that wealth “just in case” is sound financial advice.

Think of a prenup as a business arrangement or an insurance policy for both of your futures. Marriage should be an emotional, physical union as well as a financial one. With a prenup, you can spell out how your assets, joint or personal, will be distributed in the event of a divorce or death. Such agreements have existed in some form or another for thousands of years. As with any signed agreement between two parties, look to a professional who can assist you with the legal provisions you need and the required witnessing signatures. Do not be afraid to look over your prenup every few years and make any necessary alterations as your lives grow and change.
